Just kidding about the title. It was once again my pleasure to have an involvement with the
Spine Research Institute of San Diego.
The more serious side of the seminar was centered on better narrative
reporting. Better narrative reporting is best for clarity, for both the
defendant and plaintiff attorneys in a courtroom situation.
A very recent law, called Federal Rules of Evidence
803, states that “the learned treatises are not excluded by the hearsay
rule even though the declarant is available as an expert witness.
To the extent called upon by the expert under higher direct or
cross-examination, when identified by him or other witnesses as a reliable
authority, this material may be read into evidence, but may not be received
as exhibits.”
The above so states – there has been an epidemic of
insurance companies literally making attempts to minimize their exposure to
patient’s injuries. This is
done through a prostitute action, by other doctors, in which the insurance
company hires an “independent medical examiner,” or IME. This “independent medical examiner” is so independent
that he is hired and paid by the insurance company.
In the past we could not respond to the IME, even
though the insurance companies place them in a god-like position.
In 5 minutes or less they figure out the entire problem of the
patient and are willing to sell their souls for another quick buck.
Rule 803 allows physicians and chiropractors to respond to their
critic in the form of a written narrative report. The treating physician’s
response report is now accepted as evidence, and it can be read in court to
parallel the negative IME. I
would say that the majority of physicians are not even aware of this ruling.
If you have a legal case or accident, and your insurance company is
manipulating you, you need to talk to your doctor about, what I consider, a
travesty in the healing arts of prostitute reviews. These reviews actually
harm good people merely for the sake of financial gain.
Now to the good side - Our trip was a very favorable
food feast. We were able to re-establish better eating habits and exercise.
We found people there to be extremely kind and courteous, even when
you take a chubby chiropractor from Kickapoo and put him in 7 lanes of
traffic, one direction and at 70 m.p.h.
Of course it is always good to get back home and realize you had a
very successful seminar as well as kinship with people around you.
If pressure gets too tough, go to the beach, be happy,
relax, and appreciate good people around you.
